WILL WE EVER CHANGE? Most heinous rape cases in India since Nirbhaya gangrape

New Delhi: Gruesome and insane side of male chauvinism is ruling the roost these days in India, at least going by the number of rape and gangrape cases being reported on a day to day basis in the national dailies.If we peek into last year or two, such cases have only increased in number. Here are some of the worst cases reported in the past two years: 1. Badaun gangrape case Two girls, who were cousins and aged 14 and 15, went missing from their house on the night of May 27 and their bodies were found hanging from a mango tree in the village in Ushait area (Katra village) of Badaun in Uttar Pradesh on May 28 - leading to nationwide outrage and severe criticism of the SP government and local police. The postmortem report of the two girls confirmed that they were raped before murder. All the five accused named in the FIR, including constables Sarvesh Yadav, Chhatrapal and three brothers Pappu Yadav, Awadhesh Yadav and Urvesh Yadav have been arrested. Reportedly, father of the gangrape victims has rejected the government's offer of financial assistance and demanded public hanging of the culprits. UP CM Akhilesh Yadav has ordered a CBI probe in the whole incident.
2. Mumbai Shakti Mills (photojournalist & telephone operator) rape cases The trial in both the rape cases began in the month of October last year. The accused share a criminal track record and involved in various cases of sexual assault on women. Vijay Jadhav, Salim Ansari, and Qasim Shaikh were accused of assaulting both the ladies. Siraj Khan was involved in the sexual attack on the photojournalist that took place on August 23 and Ashfaque Shaikh was one of the accused in the call operator case on July 31. There was also a minor involved in both the cases and presently being prosecuted under the juvenile law. • Sexual assault on photojournalist The photojournalist had gone to the abandoned Shakti Mills area along with one of her male colleagues when both of them met these accused. Later, the girl and her male accomplice were tied up in belts and dragged to a lonely spot. The journalist was raped in turns by the group. The incident was reported on August 23. • Sexual assault on telephone operator On July 31, female telephone operator along with her boyfriend (who is her husband now), while passing through the same area (Shakti Mills) so as to take a shorter route to the Mahalaxmi station, was overpowered by the same group. The girl was repeatedly raped and her male friend beaten up brutally.
Chargesheet in photojournalist case Within less than a month, a 600-page chargesheet was filed on September 19, 2013 against the five accused (including a minor) in Mumbai’s Esplanade Court. The case against the minor (17-yesr-old offender) was registered in the Court of Juvenile Justice. The accused are charged under several sections of the IPC including gang-rape, criminal conspiracy, destruction of evidence and wrongful restraint. Although, the quantum of punishment will be decided by the honorable court tomorrow but the maximum limit of punishment can be life imprisonment for the accused which are adults and three years for the underage accused. Statements of over 86 witnesses (included mother of the victim) have been recorded in the case. Furthermore, statement of the victim under section 164 (5) of the Criminal Procedure Code has also been recorded.
Forensic and technical evidences • 22 DNA samples of the 5 accused that were found on the victim’s clothes • Mobile phone records • Finger-prints on the broken beer bottle that was used to intimidate victim • Laboratory reports of the soil samples collected from clothes of victim and accused Chargesheet in telephone operator case A 300-page charge sheet was filed against four accused on October 8, 2013 in the Chief Metropolitan Magistrates Court. The chargesheet includes statements of 56 witnesses which include the victim, her mother and male friend. The four accused Mohammed Ashfaq Sheikh, Kasim Bangali, Salim Ansari and Vijay Jadhav, have been booked on charges of gang-rape, unnatural sex, criminal conspiracy, common intention and criminal intimidation and various other sections.
3. Gudiya rape case The kidnapping and rape of the 5-year old girl in east Delhi had sparked public outrage against the alleged apathy of police in registering the case, leading to the suspension and transfer of cops of various ranks including an ACP, caught on camera slapping a young girl who was part of a crowd protesting the incident. The accused Manoj Shah, 22 and Pradeep Kumar, 20, who had fled after committing the crime, were arrested from Bihar. The accused later confessed to have kidnapped the girl while she was playing out of her house. The two accused became brutal to such an extent that they inserted candles and an oil bottle in the private parts of the girl. The accused tried strangulating and slitting throat of girl and left the spot (post 40 hours of detention) after leaving the child in the room thinking that she was dead.
4. Nirbahya gangrape case The Delhi gang rape case also known as Nirbhaya gangrape that occurred on 16 December in 2012 in Munirka, South Delhi attracted a large number of eyeballs the world over. The victim was a 23-year old female physiotherapy intern who was beaten along with her male friend aboard a private bus. The girl was gangrapes by six men present in bus including driver. Later both girl and her friend were thrown out of the bus, the accused thinking both have died in the whole affair. The girl died from her injuries thirteen days later while undergoing emergency treatment in Singapore. The incident generated widespread national and international coverage and was widely condemned, both in India and abroad. All the accused were arrested and charged with sexual assault and murder. One of the accused, Ram Singh, died in police custody on 11 March 2013 in the Tihar Jail. The rest of the accused went on trial in a fast-track court; the prosecution finished presenting its evidence on 8 July 2013. The juvenile was convicted of rape and murder and given the maximum sentence of three years' imprisonment in a reform facility. On 10 September 2013, the four remaining adult defendants were found guilty of rape and murder and three days later were sentenced to death by hanging. On 13 March 2014, Delhi High Court in the death reference case and hearing appeals against the conviction by the lower Court, upheld the guilty verdict and the death sentences.
